1.acceptance
These Terms of Use are a binding agreement between you and Kyagi. By creating an account or using the kyagi app or website, you agree to these Terms and our Privacy Policy (kyagisocial.com/privacy). If you do not agree, do not use kyagi.
2.eligibility
You must be 18 or older to use kyagi. By using kyagi you represent that you are at least 18.
3.the service
kyagi is a social app for small friend circles: you share everyday moments with people you invite, and make plans to see each other in person. Free accounts include one circle of up to 20 friends.
4.your account
You are responsible for your account and keeping your credentials secure. Provide accurate information. One account per person. You can delete your account at any time in settings; deletion removes your profile and content from the service.
5.your content
You own what you post. By posting, you grant kyagi a limited, non-exclusive license to host, store, and display your content to members of your circle solely to operate the service. We do not sell your content or use it for advertising.
6.zero tolerance for objectionable content
kyagi has zero tolerance for objectionable content and abusive users. Content that is harassing, threatening, hateful, violent, sexually explicit, exploitative, or otherwise objectionable is prohibited and will be removed. Accounts that engage in abusive behavior will be terminated.
7.reporting and blocking
You can report any post or comment, and block any user, at any time from within the app. Blocking a user immediately removes their content from your feed. All reports are reviewed within 24 hours, and we take appropriate action, including content removal and account termination.
8.prohibited conduct
Do not: harass, threaten, or abuse others; post content prohibited by section 6; impersonate anyone; upload malicious code or attempt to break or probe the service; use kyagi for anything unlawful; scrape or resell the service.
9.termination
We may suspend or terminate accounts that violate these Terms. Enforcement decisions, including whether to warn, suspend, or terminate, are made case by case at our discretion. You may stop using kyagi and delete your account at any time.
10.intellectual property
kyagi, its design, and its branding belong to us. These Terms grant you no right to use the kyagi name or brand.
11.privacy
Our Privacy Policy (kyagisocial.com/privacy) describes what we collect and how we use it.
12.disclaimers
kyagi is provided "as is" and "as available," without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not guarantee the service will be uninterrupted or error-free.
13.limitation of liability
To the maximum extent permitted by law, kyagi will not be liable for indirect, incidental, special, consequential, or punitive damages, or lost data, arising from your use of the service. Our total liability for any claim is limited to the greater of $50 or the amount you paid us in the past 12 months.
14.changes
We may update these Terms. If we make material changes, we will notify you in the app or by email. Continued use after changes take effect means you accept the updated Terms.
15.governing law
These Terms are governed by applicable law, and disputes will be resolved in courts of competent jurisdiction.
16.apple app store addendum
If you use kyagi on an Apple device: (a) these Terms are between you and kyagi only, not Apple, and Apple is not responsible for the app or its content; (b) your license is limited, non-transferable, and for use on Apple-branded devices you own or control, as permitted by the App Store Terms of Service, except as allowed via Family Sharing; (c) Apple has no obligation to provide maintenance or support; (d) if the app fails to conform to an applicable warranty, you may notify Apple and Apple will refund the purchase price, if any; to the maximum extent permitted by law Apple has no other warranty obligation; (e) kyagi, not Apple, is responsible for addressing claims relating to the app, including product liability, regulatory compliance, and consumer protection; (f) kyagi, not Apple, is responsible for third-party intellectual property claims; (g) you represent you are not in a country subject to a U.S. government embargo or on any U.S. government list of prohibited or restricted parties; (h) you must comply with applicable third-party terms when using the app; (i) Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them.
